At what point does Yahoo, inc become responsible for spam bots and the failure to properly deal with them?

For Quite a while now I have been receiving various spam messages from spam bots on my yahoo messenger. So at what point can I hold Yahoo responsible for not protecting my privacy and doing something about it?

I have easily filled up the 100 blocked user accounts and have started to file abuse reports against the newer generation of spam bots.
